WHO IS SUED AND PAYS FOR YOUR INJURIES AND VEHICLE DAMAGE?

ICBC as the Province’s insurer pays for personal injury and vehicle damage claims. However, if you are involved in a motor vehicle accident you do not directly sue ICBC, rather you sue the at-fault-motorist. In some cases, you will have to sue a family member or friend if they were driving and caused the accident, while you were a passenger. Remember, it is not your family member or friend who will be paying for your personal injury and vehicle damage claim, it will be ICBC.

One example of where you sue ICBC directly is if ICBC denies you the Part 7 Benefits you are entitled to.
